Work Heights Privacy Policy

We, Work Heights (operated by Dean Machine LLC, "Work Heights," "we," "us," or "our"), explain in this Privacy Policy (the "Policy") how we collect, process, and/or use information that we receive via our websites, emails we send, and mobile applications (collectively, the "Platform") that link to this Policy, as amended from time to time. This Policy describes how Work Heights collects, processes, uses, shares, and secures the personal information you provide. It also describes your choices regarding use, access, and correction of your personal information. For purposes of this Policy, personal information means any information relating to an identified or identifiable natural person.

This Policy applies only to information we collect, process, and use through the Platform. This Policy does not apply to information that we collect through other channels, such as information that we collect offline, from other websites, or from emails you send us.

Please read this Policy carefully to understand our policies and practices regarding your information and how it will be used in the services we provide through the Platform.

By using the Platform, you understand and agree that we are providing services for you to post content to the Platform including, but not limited to, audio files, video, images, photographs, text, or data included in any other user-generated content that may be collected and uploaded by you (collectively, "Content"). That means that, at your election, other members of the Platform may search for, see, use, or share your Content, consistent with the terms of this Policy.

IMPORTANT: Even if you have a permanent place of residence in a country outside the United States, your information may be transferred to, stored, processed, and used (as described in this Policy) within the United States.

Information We Collect

We collect information about you to provide our services, verify your identity, and maintain the safety of our community and locations.

Personally Identifiable Information

In order to access certain parts of the Platform, or to become a member, Work Heights may require you to provide personally identifiable information, which may include, for example, your email address, photograph, government-issued identification, and the contents of any Content you submit.

Information You Give Us

Account Information. When you first sign up, you will provide information that could be Personally Identifiable Information (e.g., your email address, photograph) or non-personally identifiable information (e.g., hobbies, favorite activities, occupation, and other information you choose to disclose).

Identity Verification Information. New members are required to complete identity verification through Stripe Identity, a third-party identity verification service. As part of this process, you will be asked to provide:

  • A photo of a government-issued identification document (such as a driver's license, passport, or state ID); and

  • A live selfie photo, used to confirm that you are the person pictured on the identification document.

This information is collected and processed by Stripe Identity on our behalf. Stripe stores the underlying images, and Work Heights has the ability to access, review, and download this information as needed to confirm your identity, investigate suspected fraud, or address safety and security concerns at our locations. We use this information solely to verify your identity as a condition of membership and to maintain the security of our community; we do not use it for marketing purposes.

By submitting a government-issued identification document and a selfie photo as part of the identity verification process, you provide your affirmative, written consent to Work Heights' collection, use, storage, and limited disclosure of that information as described in this section and the "Biometric Identifier Information" section below.

Biometric Identifier Information

Your selfie photo, and any facial geometry or similar data derived from it during the identity verification process, may constitute "biometric identifier" or "biometric information" under applicable state biometric privacy laws. This section describes our specific practices with respect to that information.

  • Consent. We do not collect, capture, or otherwise obtain your biometric identifier information without first obtaining your informed written consent, as described above. You may withdraw this consent by declining to complete identity verification, though doing so may mean you are unable to become or remain a member.

  • Purpose of collection. We collect and use biometric identifier information solely to verify your identity as a condition of membership, prevent fraud, and protect the security of our members and locations. We do not use biometric identifier information for any other purpose without obtaining additional consent.

  • No sale or profit. Work Heights does not sell, lease, trade, or otherwise profit from your biometric identifier information.

  • Disclosure. We do not disclose, redisclose, or otherwise disseminate your biometric identifier information except: (a) to Stripe Identity, our identity verification service provider, to complete the verification described above; (b) with your consent; (c) to complete a financial transaction you requested or authorized; (d) as required by law, valid warrant, or subpoena; or (e) as necessary to protect the safety of our members, staff, or locations.

  • Retention and destruction. We will permanently destroy your biometric identifier information upon the first of the following to occur: (i) the purpose for which it was collected has been satisfied, including if you request deletion after your membership ends as described under "Deletion of Identity Verification Data" below; or (ii) three (3) years after your last interaction with Work Heights, whichever occurs first — unless we are required to retain it longer to comply with a valid legal obligation.

  • Security. We store and transmit biometric identifier information using reasonable administrative, technical, and physical safeguards, and in a manner that is the same as or more protective than the manner in which we store other confidential and sensitive information.

User Content. Some features of the Platform allow you to submit Content. We encourage members to add Content, and when you share Content via the Platform, you should think carefully about what you choose to share with your channels or make public.

Information We Collect from Your Use of the Platform

Activity. When you use our Platform, we may collect information about your activity, such as resources or events you select or for which you RSVP.

Location. When you use our Platform, we may collect information about your location. With your consent, we may also collect information about your precise location using methods that include GPS, wireless networks, cell towers, Wi-Fi access points, and other sensors. You typically have the ability to turn such services on or off.

Camera, photos, and audio. Some services offered through the Platform allow us to collect images and/or audio/video from your device, camera, and camera roll — including for the identity verification process described above.

IP Address Information and Other Information Collected Automatically. We automatically receive and record certain information from your web browser or our applications when you access and use the Platform, which may include your IP address, hardware model, operating system version, unique device identifiers, and mobile network information.

Information Collected for Push Notifications. When you access the Platform through a mobile device and allow push notifications, a device token will be generated and stored on our servers until you log out.

How We Use Information

Work Heights is a membership-based coworking community. We use the information we collect to operate the Platform, verify the identity of prospective and current members, maintain the security of our locations, provide member services, and improve those services. Work Heights will always have access to the personal information on your account and may use it to maintain and provide the Platform to you. We may use your information in either aggregated or individual form.

Your Privacy Rights

Work Heights does not discriminate against users who exercise any of these privacy rights. We respond to all requests we receive from individuals wishing to exercise their data protection rights in accordance with applicable data protection laws, within a reasonable timeframe. Notwithstanding the foregoing, we reserve the right to keep any information in our archives that we deem necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Deletion of Identity Verification Data. Once your membership ends, you may request that Work Heights delete the government ID and selfie images collected during identity verification, along with the associated verification records. You may submit this request by emailing Support@WorkHeights.com. We will process such requests within a reasonable timeframe, subject to any legal, security, or fraud-prevention obligations that require us to retain certain records for a defined period after membership ends.

How Long We Keep Your Personal Information

We keep your personal information only so long as we need it to provide the Platform to you and fulfill the purposes described in this Policy, including verifying your identity and maintaining the security of our community. Retention periods can vary based on the type of information and how it is used, and are based on criteria that include legally mandated retention periods, pending or potential litigation, our intellectual property or ownership rights, contract requirements, operational needs, and historical archiving.

Identity verification data (government ID images and selfie photos) is retained for the duration of your membership and for a limited period afterward to address security or fraud concerns, unless you request earlier deletion as described above and no legal or operational obligation requires continued retention.

When we no longer need to use your personal information and there is no need for us to keep it to comply with legal or regulatory obligations, resolve disputes, or enforce our agreements, we'll either remove it from our systems or depersonalize it so that we can't identify you.

Third Party Sites and Service Providers

This Policy does not apply to the practices of third parties, including third-party websites, services, and applications that you access through the Platform, or that we use to provide services to you (such as Stripe Identity for identity verification). We encourage you to review the privacy policies of any third-party services you access, including Stripe's privacy policy at stripe.com/privacy.

Security Safeguards

Security. We employ physical, electronic, and managerial measures to safeguard the information we collect online, including identity verification data. However, no organization can fully eliminate security risks, so we cannot make guarantees about any part of our services.

Protecting Your Information. We implement and maintain reasonable measures to help safeguard your information, but we make no guarantee that these efforts will make your information completely secure. We encourage members to think carefully before sharing content on the internet.

Privacy of Minors. To access or use the Platform you must be at least 13 years of age or, if older, the age of majority in your jurisdiction. If you become aware that a child has provided us with personal information without parental consent, please contact us at Support@WorkHeights.com. If we become aware of this, we will remove such information and terminate the child's account.

Data Controller. The information about you that we collect, process, and/or use through the Platform is hosted, controlled, and services are provided by Dean Machine LLC (d/b/a Work Heights).

Updates to Our Privacy Policy

We may revise this Policy from time to time by posting an updated version on the Platform. The revised Policy will be effective immediately for unregistered users and users registering accounts or otherwise acknowledging the Policy on or after the revision date. For other users who registered accounts before the revision date, it will also become effective immediately; however, they may object to the new Policy within thirty (30) days after the revision date. If we make a change that we believe materially reduces your rights or increases your responsibilities, we will notify you by email or by means of a notice on this website prior to the change becoming effective. Your continued use of the Platform is subject to the most current effective version of this Policy. If you object to the Policy after it becomes effective for you, you may no longer use the Platform.
